Abstract

Nowadays there are some technologies that had been used or to be used in
war, unmanned drone is the most visible as an example that latest technology.
United States use an unmanned drones for a military attack with a reason that the
unmanned drones are the most effective in rooting out terrorist. But in fact
unmanned drones can give an excessive wound and caused misery to man. The
purpose of this research is to determine the use of unmanned drones regulation by
International Humanitarian Law and to determine the United State unmanned
drones attack in Pakistan in 2009 by International Humanitarian Law and to
determine the case of United States of America’s unmanned drones attack in
Pakistan in 2009 reviewed according to International Humanitarian Law.
The research method used is the juridical norm, by means of a statutory
approach method and the approach of the case. The source of the data used are
secondary data. The data are then analyzed using the methods of normative
qualitative.
Based on the survey results of research that the use of unmanned drones
not clearly regulated in humanitarian international law. Unmanned drones were
a illegal its use in an armed dispute internasional because it violated the
principles laid down in humanitarian international law. Because many of the
violations committed by the use of unmanned drones, it needs to be made to the
regulations governing the use of unmanned drones in armed conflict and provide
restrictions deemed appropriate in its use. The united states unmanned drone
attack in Pakistan in 2009 is a violation of the sovereignty of other countries.
United States military operation to capture terrorists in violation of the principle
of International Law, namely the principle of Humanity, the principle of
limitation, and the principle of proportionality. United States have a duty to
protect its citizens from terrorist threats, but such obligations should be balanced
against the obligation to protect the lives of innocent civilians in the conflict
between the State and terrorists.
