Abstract

Court verdict must contain a judge’s argument or reason in a law consideration
known as a ratio decidenci. Judge’s ratio decidenci included judge’s Pengadilan
Tata Usaha Negara must be based on legislation ordinance. To reach the decision
filling a justice for many sides and societies generally is acquainted as a freedom
verification basis. This principle gives a freedom to judge’s Pengadilan Tata
Usaha Negara for deciding verification burden and also making a verdict to get
material truth. In this case, the researcher is interested to canvass about a ratio
decidenci in the verdict number 03/G/2011/PTUN.Smg and an application of
freedom verification basis of judge’s Pengadilan Tata Usaha Negara looking into
and discontinuing the lawsuit. In the answering of its case above, the researcher
uses approach method arranged by the research type of normative juridical with a
legislation, a conceptual, and a case approach. The used analysis method is
qualitative method. The result of the research states that ratio decidenci of judge’s
Pengadilan Tata Usaha Negara isn’t proper with legislation ordinance and makes a
mistake in applying freedom verification basis.
