Abstract

Based on the results of the adjudication of district court on case No. 375 / Pdt.G /
2007 / PN. JKT. BAR on July 29, 2008. Verditcted PT Bank BNI feel harmed by the
release of the verdict was in favor of the Plaintiff. So that the abolition of mortgage deed
certificate lawsuit arguing on behalf of the Plaintiff has changed its name to the name of
Gunawan (Defendant I) illegally, where the Defendant I have the certificate as collateral
for loans TI, TII, tiII, of TIV (PT BNI) at 15 billion. Against the District Court filed by
PT Bank BNI general remedies to extraordinary that Reconsideration. Writers interested
in researching and writing a thesis with the title “PERMOHONAN PENINJAUAN
KEMBALI TENTANG PERJANJIAN KREDIT BANK YANG DITOLAK (suatu
tinjauan yuridis terhadap Putusan Nomor. 755 PK/Pdt/2012 Mahkamah Agung)”.
This study used a juridical normative method. The specification of this study
analytical approaches. That aims to determine the application of the law in the Supreme
Court rejected the request for a judicial review and legal consequences refusal of the
request judicial review. Based on the results obtained the conclusion that the application
of the law in the Supreme Court rejected the application for judicial review is
appropriate, it is not there any oversight of appeal judges, the judges of appeal, and the
first petition for judicial review. The legal consequences of the refusal for
Reconsideration Request that states the decision No. 375 / Pdt.G / 2007 / PN. JKT. BAR
on 29 July 2008 still have binding legal force to the parties.
