Abstract

Cosmetic has became the primary need for the human, especially for the female
who always wants to perform beautiful. The female interest to keep always looking
beautiful this has been used by the businessman who has bad interest. Recently there are
many of the cosmetic that contains the dangerous elements, especially in the Regency of
Banyumas. Therefore, the purpose of this research is to find out the protection of law for
the female as the consumer to the cosmetic distribution that contains the dangerous
elements in the Regency of Banyumas. This research uses the method of normative
juridical by using the approach of Statute Approach that has the descriptive characteristic.
Data source in this research uses the secondary data from the literature material that is
supported with the primary data from the result of interview. Data is explained of
narrative texts systematically. Method of data analysis in this research uses the method of
qualitative normative. The result of research shows that the protection of law for the
female consumer for the cosmetic distribution that contains the dangerous elements has
been conducted by the government and its officers by giving the counseling and
controlling by Medicine and Food Controller Board (BBPOM Semarang) under the
regulation BPOM RI Number HK.03.1.23.12.11.10052 about Supervision Production and
Distribution of Cosmetics, and than punishment based on Ordinance Number 36 in 2009
about the Healthy. The controlling by BBPOM is conducted using two methods that are
Pre Market and Post Market. Pre Market is the controlling that is conducted before the
cosmetic products are distributed such as the adjustment and examination for the safety
quality of cosmetic. Post Market is the controlling that is conducted after the cosmetic
product is distributed such as inspection of the production and distribution devices,
sampling and laboratory examination for the cosmetic that have been distributed,
adjustment and controlling of the cosmetic advertisement and education information for
the society and public warning. Government in this case has protected the rights of
consumer which has been regulated in the Ordinance Number 8 in 1999 about the
Consumer Protection.
