Abstract

Article 2 paragraph 1 Law Number 1 Year 1974 explains that
marriage is legitimate, if conducted based on its religion and belief
regulation. Sistematyc interpretation of the legitimate marriage can be
interpreted by using Article 2 paragraph 1, Article 6 until Article 12 Law
Number 1 Year 1974, but the judge only considers the law based on the
charge reason proposed. As what happen on the Case Number :
0317/Pdt.G/2014/PA. Bjr which was not granting the pleading of pleader.
The research method Metode is normative juridicial.
The result of research shows that the interpretation by the judge is
systematic interpretation. The judge believe that there is no indication of
misinterpretaion or fraud based on Article 27 paragraph 2 Law Number 1
Year 1974, Article 72 paragraph (2) Islamic Law Compilation, and
grammatical interpretation about misinterpretation of Defendant status.
The Defendant status as widow, later written as virgin is not proven as
fraud or misinterpretaion because of pleader‟s suggestion that the
defendant status written as virgin. There is no obscure lible because of the
precise subject that does not cause eror in persona. The judge in
considering of cancelling the pleadingactually should not directly to the
articles about the misinterpretation nor fraud of wife or husband, but the
judge should interprete the requirement of legitimate marriage that the
marriage should based on approval on brides which determined on Article
6 paragraph 1 Law Number 1 Year 1974.
