Abstract

Judicial power is power that is freedom and independent from outside the
judicial power. As one existance of judicial power that is free and independent,
judges are given the freedom to investigate and decide a case. The judges have a
conference meeting confidential before decide a case. In a conference meeting of
judges may occur dissent of opinion among the judges.
Based on the results of the study indicated that the consideration of
majority opinion are Judex factie does not make mistakes in the application of the
law, because the sale and purchase agreement number 225 dated 23 June 2009,
has been legitimately qualify formal and material validity of an authentic deed.
While the consideration of the judges who expressed dissent of opinion is Judex
factie have made a mistake in the application of that law does not consider that the
agreement contravene at Section 1320, Section 1338, Section 1474 and Section
1513 of the KUHPerdata. Effect of there are dissent of opinion in Decision No.
472 K / Pdt / 2012 was that decision to have legally enforceable. In addition, the
presence of a dissent of opinion in the decision have positive consequences
(excess) and negative (weakness).
