Abstract

Construction of the discipline of civil servants is one of the government’s
authorities which implementation delegated to local governments. One of the
purposes of civil servants disciplinary regulations is to improve the discipline of
government institution, both the central government and local governments.
Offices of education and training (Diklat) Banyumas regency as one of the
institution that provide education and training for civil servants in Banyumas
regency participate in the establishment and enforce the rules of discipline which
has been issued by the government, in this case is the Government Regulation
Number 53 of 2010 about Civil Servants Discipline, as the replacement for the old
discipline regulation that is the government regulation number 30 of 1980.
According to the condition that mentioned before, the problems that
researched is: How The Implementation of The Civil Servant Disciplinary
Regulations at The Office of Education and Training (DIKLAT) Banyumas
Regency?
The research method used in this study is yuridis normative approach
method. Specification used is the of prescriptive specification research. Sources of
the law substances is secondary data. Substances of law obtained using
documentary and literary study method. Substances of law are obtained and
presented in the form of narrative text. The analysis of the law substances in this
study used deductive logic through analysis of normative qualitative data method.
Based on the results of research and discussion, it can be concluded as
follows:
Application of disciplinary sanctions in the Office of Education and
Training (Diklat) Banyumas carried out in accordance with the process or
mechanism contained in the civil servant disciplinary regulations which is the
Government Regulation No. 53 of 2010 on the Civil Servant Discipline. Before
the civil servant got discipline punishment, the supervisor have to check the civil
servant that suspected of committing breach of discipline, the investigation held in
private and the result are set forth in the investigation report (BAP). If there are
any objection with the decision and sanction that imposed to him, then he can
submit an objection to a civil or administrative appeal.
